Basically. Instead of referring to it as an “album”, calling it a playlist/remix should be a little safer.

It’s definitely just a series of “what if” situations. It’s more or less for me and a couple friends but we need an intro. So I came here. The legal thing happened to be what took off as far as conversation goes so I ran with it.
I do believe on post one I said it was just an elaborate mix cd and that’s still all it is.

My understanding was as long as you’re not making money off of it now or in the future there’s nothing anybody can do except dead it.
They can sue you for 3 times the ammount of damages to their sales that they can allege came from your bootleg. So if you get one download, they can claim a loss of 1 album sold for each of the albums that your songs come from, so if you got songs from three albums, they can hit you up for up to $135. 3 albums at $15 dollars each. Times 3 times the damages. If 100 people download, they can go after $13,500 for your free download, etc.

Again, considering that when people were making money off of them on Etsy all Psychopathic did was order a cease and desist, I think I’d be safe. The intro is in the works and whatnot and if people want it, that’s cool. I might find a way to make sure someone hears the chopped up stuff and the full, fake ass, elaborate fuckin mix cd of a Jokers Card but cover, intro, and suggested tracklist is safe no matter what. As long as I’m not saying that it’s Insane Clown Posse.

If it’s done and they contact me telling me to stop and then sue me, I’ll be sure to come back here and tell you I was wrong, @scruffy. I wouldn’t hold your breathe on them contacting me though. Not because I think it therefor it’s true but because who the fuck am I? When their music is on piratebay right now with over 500 people stealing one album and well over a thousand people stealing other albums from them, I think a mix cd made between a couple friends won’t show up on their radar. Again, I might be wrong and if I am I’ll be sure to admit it.

Here’s my solution. Make a playlist on Youtube. Track #1, your intro with your artwork as the video. The rest? Already-exisiting uploads that others have put on there. Wanna share it? Share the link to the playlist. Takes all accountability off of you and puts it on the original uploaders. If anyone gets gone after, it’s them. You’re completely in the clear.
