There is no law saying you can’t use someone’s name. The picture is a little more complicated but since they own the photo they can use it. This would be different if they filmed him without his consent.
If the POS wants to sue for libel he has to prove damages related to what they said and that what they said was dishonest or misrepresents him. Also he would need to foot the bill for filing for court costs and lawyers, which can get expensive.
