So I'm listening to old love line recordings with violent j (10-25-00), and this chick just called in and it rekindled an old debate In my mind. Anyways, she was way super drunk to the point of black out and this dude had sex with her, and she's talkin about askin if it's rape. The doctors on the show say yes, J says no. They say that since she was past the point of awareness, it is rape. J says no because it's bogus and there's no way she was that drunk and this is the type of shit that gets innocent dudes in jail. So faygoluvers, is tagging blackout drunk girls (not including significant others) rape or basically is she just drunk n horny and now she regrets it? I personally think it's a slippery slop cus both sides have strong points. I think, if charges are pressed, it should be like manslaughter vs. Murder, still get you jail time but not as much/less serious offense. Imo that's the only way to make it kinda fair. That way if the dude is a dick he goes where he belongs, but if he is in fact the victim of the scenario he isnt away for life

Legally you need to be able to consent to sex. If you are unconscious, you can not give consent. Intent is another area, and it has proven difficult if not impossible to prove intent. Legally your only safe bet is to walk away. No piece of ass is worth a rape charge.
Are you saying that alleged rapists should get lesser charges if the alleged victim is unconscious? Or if they thought their alleged victim wanted it? Because I see some potential loopholes there that could be exploited fairly easily. The last thing rapists need is a little more wiggle room.

i believe once a poll is made it can not be edited. You can start to make a thread with poll get the embed code to it and replace the poll in this.

And I get what guest was saying, and I guess what I mean was a provision needs to be made for those specific circumstances, what I'm saying is it's way to easy in those cases for a chick who did want it at the time say she was blacked out and get a guy thrown in jail. That almost happened to a dude I used to hang with, he left his girl and she started saying he raped her to get back at him. I don't disagree with in the case of a unable to consent person calling it rape, I just think the accused need some protection too because innocent people get locked up for it.

I guess by these definitions I took a couple bars years ago and got raped by my homies baby mama(they hadn't gotten together yet). So is that rape?

It is a very slippery slope I gotta agree on that. There was a known trifling bitch that I used to live around. Straight conniving. She was basically banging these two dudes for blow and alcohol. The charges ended up getting dismissed because she was a felon(broke into a store and stole baby formula, long story) and her testimony wasn't reliable. It could easily happen to somebody though.

im not gunan vote because well i think it can go either way.
If she was unconcious tehn yes it is rape, but she may have consented while concious adn not remeber it then it is not rape.

I have never raped anybody, but if I ever did, I would rape a dead person. That way, they couldn't catch me off the victims description. Pretty good thinking, huh? Not saying that I would, but if I was gonna rape anything, it would be a corpse.
